Legal Committee Initiates Drafting of Constitutional Declaration to Guide Syria’s Transitional Phase and Ensure Stability

Legal Committee for Drafting the Constitutional Declaration: in light of the legal vacuum resulting from the cancellation of the 2012 constitution drafted by the Bashar al-Assad regime, it has become necessary to draw up a constitutional declaration that regulates the transitional phase and guides the state’s path towards stability and reconstruction, which is not a substitute for the permanent Constitution.

-The constitutional declaration derives its legitimacy from the National Dialogue Conference and the victory conference, where the various components of the Syrian people agreed on the need for a legal framework that regulates the transitional phase, defines the foundations of governance and guarantees rights and freedoms.

-The constitutional declaration is a legal document aimed at managing the transitional phase in Syria, as it defines the powers of the three authorities (legislative, executive and judicial).

-The Constitutional Declaration lays down the general foundations of the system of government to ensure the flexibility and efficiency of State administration during this sensitive period, in order to preserve the country’s political and social unity and territorial integrity.

-The Legal Committee is responsible for writing the draft constitutional declaration after examining the most important principles and articles it must contain, in the country’s interest and in keeping with the requirements of the transitional phase.

-The committee is keen to draw ideas from the national dialogues and debates that took place in the constitutional construction workshops during the National Dialogue Conference.

-With the completion of the drafting work, we will submit the proposal to the presidency of the Republic in a step aimed at establishing a new phase based on law and institutions to ensure a transition towards a more stable and just Syria.
